Prosecutors Subpoena Tons Of Info On Student Journalists Who Provided Information To Reopen Murder Case

Northwestern University's Medill Innocence Project is a very cool program for journalism students, teaching them investigative reporting techniques in the real world, by having them investigate potential wrongful convictions. As the program's website notes, it's helped free 11 wrongfully convicted individuals, five of whom had been on death row. However, some prosecutors don't really like being proven incorrect. In one of its latest projects, the Innocence Project has provided enough evidence to reopen the case of Anthony McKinney, who has been in jail for 31 years for allegedly killing a security guard.

However, state's attorneys in Illinois are now subpoenaing all sorts of excess information on the students themselves, including their grades, the grading criteria, student evaluations, and private notes and and off-the-record interviews that were used in gathering the information necessary for the case. While the state's attorney Anita Alvarez is defending this overreaching subpoena effort, it has many concerned that this is really just an attempt to intimidate the students and create a serious chilling effect on this type of investigative research. It's difficult to see how the student's grades make any difference at all in whether or not McKinney is innocent or guilty.

Oh Look, Bloggers Can Do Investigative Reporting Too

Whenever we talk about bloggers or others outside the mainstream press doing some kind of investigative reporting, some traditional journalists tend to stop by and complain that even if it was done this one time by this one individual, that individual won't stick around and do any future investigative reporting. However, that seems to miss the point. With the new tools of production these days, the simple fact is that if there's a story to get out, anyone can now get it out there and get it attention. If they only do it once in their lives, that's great. The next story will be done by someone else. Again, this isn't to knock professional reporters -- who I still believe strongly have a place in this ecosystem. But the complaints that investigative reporting simply won't be done without newspapers still rings incredibly hollow.

In the latest example, sent in by Chris, a blogger in Florida has apparently been doing an excellent job breaking a number of key stories concerning a recent murder. Even the local police say they're now seriously investigating leads brought to their attention by this guy's reporting -- even as the local mainstream press continued to argue against what the guy was reporting. It's still not settled what happened exactly, and some of the blogger's ideas may not turn out to be true, but as the NY Times notes, he has not yet had to retract any of his posts, and many of the factual points he's raised have later proved to be true.

But Who Will Do Investigative Reporting Without Newspapers?

Pat was the first of a few of you to send in this amazing investigative report done by the folks at The Smoking Gun, outing a bunch of "griefers" who go by the name Pranknet and who have caused a tremendous amount of trouble and damage throughout the US with their phone-based pranks. The story is fascinating for a variety of reasons, and well worth reading, but it (once again) highlights the fact that detailed deep investigative reporting isn't something that only newspapers can do. The reporters from TSG went well-beyond your typical investigative report as well. Rather than just outing the "leader" of the group, they tracked down numerous accomplices (many of whom insisted they couldn't be found) and outed them all. Apparently police and the FBI had been trying to track down members of this group for a while, but some good old investigative reporting -- from a website -- beat them to it.

Oh Look, Citizen Journalists Can Do Real Investigative Reporting

The newspaper people will tell you that if they are obliterated by the evil internets one of the big loses will be investigative journalism. If it hadn’t been for those gritty investigative journalists the newspaper hires there’d be no Watergate, no Whitewater Gate, no ‘Gates of any kind.

Of course, that’s just plain silly. Newspapers didn’t invent investigative journalism any more than they invented news or reporting news.

In fact, in this digital age where anyone willing to do the work can spill the beans to a massive audience, there is more reason than ever for independent investigators to step up to the plate. The folks at QuarryGirl, a blog dedicated to animal rights, have done just that.

Having been given a great deal of anecdotal proof that some food at Vegan restaurants around LA contained animal by-products, they decided to see if they could prove it. One might assume, as a bunch of bloggers with, potentially, no J-school experience whatsoever, they might make a hash of things. Instead, they made a plan:

Here's an outline of the plan:

  • Locate a facility that has no traces of egg, casein or shellfish in which to perform the advanced tests
  • Purchase anti-contamination equipment including industrial sterilization supplies, lab coats, uncontaminated bags, swabs, razor blades, gloves and floor coverings
  • Obtain highly restricted industrial food testing "kits" only available to the food manufacturing industry
  • Develop a regimented process to test each food item with the highest standards of inter-test cleanliness, ensuring that absolutely no food particles from one food item contaminate another
  • Select a diverse set of menu items from 100% vegan-only restaurants throughout LA (with one exception, see later)
  • Order the food for carry-out, and seal it in an airtight bag in its original packaging either inside, or very close to the point of purchase
  • Transport the food items to the testing facility intact and sealed, and perform the tests within 48 hours of purchase, keeping them refrigerated until immediately before the test
  • Develop a strict bracketing control, with a thorough analysis of the testing facility and equipment before testing: A negative control to ensure no pre-existing contamination, and a positive control test on a known-positive food product (containing all three target non-vegan items) to ensure that the tests do indicate positive results
  • Conduct the test in absolute secrecy to ensure that no restaurant would know they were providing samples, and pose as regular customers ordering take-out food in a normal way, with no disclosure that the items would be used for a test.

So, we divided up the work between us, and dedicated a Friday evening, Saturday and Sunday as well as over $1,000 of our collective money to pulling off the most extensive scientific test that we know of to find out, once and for all, if samples of restaurant food are vegan or not.

This is just one example of how the inevitable death of newspapers will simply not be the information apocalypse they’d like you to think it will be.

Perhaps Watergate Leak Credit Should Go To The FBI More Than To Woodward And Bernstein

We've talked in the past about how those complaining about the supposed "loss" of investigative journalism, if newspapers go away, are wrong. First, investigative journalism of the kind that people think about (i.e., Woodward and Bernstein breaking Watergate) is a relatively new phenomenon, and was not a common part of newspaper journalism until just a few decades ago. Second, very few newspapers put that much in the way of resources towards investigative reporting anyway. Third, there's nothing stopping other organizations from doing investigative reporting -- and we've been seeing a growing range of new online publications that focus on investigative reporting and do a great job of it. But a separate point is that it's often really not the investigative reporters who uncover the story, but the folks involved in the news themselves -- and those folks rarely get credit for providing the info that makes the journalistic effort possible.

Over the weekend, the news came out that the NY Times actually had the Watergate story before Woodward and Bernstein at the Washington Post. The acting director of the FBI leaked it to the Times just before Mark Felt, the associate director of the FBI, leaked it to the Washington Post (and became immortalized as "Deep Throat"). As Jay Rosen points out, this really means the FBI "broke" the story just as much as Woodward and Bernstein did. If there's a story that needs to get out there, never underestimate the folks on the inside for leaking it to get it out there -- and then there will be no shortage of folks to help spread the news. Again (so people don't misinterpret this), I'm not saying investigative reporters aren't needed -- but that not all of the story comes from the reporters themselves. And, on top of that, there are a growing number of publications willing to pick up the slack.

Copyright, Investigative Reporting Online... And Domino's Pizza Grossout

People have been submitting various versions of the infamous Domino's Pizza employee grossout video of two employees doing... er... bad things to food, that's been the talk of the social media world all week, but there really didn't seem to be that much of real interest to talk about here -- or at least nothing that hadn't really been discussed to death elsewhere. As plenty of folks have pointed out, the whole event and Domino's reaction (who knows how successful it will eventually be) will certainly become a regular case study concerning "social media" and how companies can and should respond to certain events. On the whole, I think Domino's has made the best of a really awful situation which has no really good response.

That said, there were two interesting side stories involved in all of this that haven't received much additional attention, but both seem to fit into themes we discuss here on a regular basis. The first is that, in the NY Times' coverage of the story, it notes that the woman involved, Kristy Hammonds, eventually used a copyright claim to get the video taken down from YouTube -- though, of course, they're now available in many more places. It seems like an odd sort of thing to try to pull down via a copyright claim. After all, she had put the video up on YouTube in the first place, even if she later came to regret it. And, by this point, the video is clearly part of a larger news story, so it's not clear if there's really a legitimate DMCA takedown to be issued over the video... Of course, in the end, it's really a meaningless gesture. The video is spread so far and wide that no takedown is going to make it disappear.

The second issue of relevance is the fact that it was folks online at the always excellent Consumerist website who were able to take the original video and track down the actual location of the Domino's franchise in question, and to alert Domino's corporate execs. While we keep hearing old school journalists whine about how no investigative reporting gets done without newspapers, this situation shows exactly how a group of motivated, interested folks, can do plenty of sleuthing and exposing of malfeasance themselves. That's not to say, of course, that this is "the model" for investigative journalism -- but to show that the whole space is changing these days, and it no longer requires a classically trained journalist in every situation. If an investigation needs to happen, there are ways to make it happen.

Online Only Investigative Reporting Group Wins Investigative Reporting Award

We still haven't quite figured out why some newspaper folks insist that you need print newspapers to do investigative reporting. A few weeks ago, we noted that there were a growing number of quite successful online only investigative reporting organizations. One of which was VoiceOfSanDiego.com -- funded by a bunch of local businesses who felt there wasn't enough local investigative reporting in San Diego. Now Nick writes in to let us know that VoiceOfSanDiego.com has won a top award in investigative reporting, the IRE or Investigative Reporters and Editors award. The award was for online investigative reporting, but it clearly wasn't limited to just online-only publications, since at least one traditional newspaper was included in the finalists.

Detailed Investigative Report On College Sports Recruiting Violations Dismissed As 'Blog' Story

We've been pointing out that just because journalism is moving away from print newspapers, it doesn't take away from investigative journalism, at all. In fact, we've seen how there are a number of new online investigative journalism operations that are moving in to pick up the slack. In fact, in the sports realm, it's been pointed out before that the best sports journalists are getting snapped up left and right (for much higher salaries) by the various online entities, and they're still doing tremendous investigative reporting work. Just last week, Dan Wetzel and Adrian Wojnarowski, both well-respected sports writers with pretty long resumes in the field, broke a story about how UConn had violated recruiting rules.

It had everything that a typical investigative report should include. It involved a six-month investigation, and the amount of background and detail is quite impressive. It's exactly what an investigative report should be, even if it was published only online and there were no subscribers who had to "pay" to make it happen. It seems to pretty clearly disprove the idea that the only way to fund investigative journalism is to have it paid for by subscribers. That's never actually been true in the past, but it's even clearer with this story.

Still, perhaps the most ridiculous part of the story, as pointed out by one of our readers, Dave, is that the basketball coach who was implicated for recruiting violations in the story, Jim Calhoun, decided that, rather than respond to the allegations, he could dismiss them entirely because they appeared online only:

It was a newspaper story that ... it wasn't a newspaper, I'm sorry. It was a blog story that appeared, I guess, in something I probably can't get a hold of, which is Yahoo! And very simply my comments are what I said.
So, this guy thinks that since the publishing of an in-depth investigative report happened in an online only source (a) it's obviously "a blog story" (even though it wasn't) and (b) it can be waved off. Of course, now that the story isn't just appearing on "a blog" -- it's appearing in the NY Times and the NY Daily News and the Boston Globe, among many other print newspapers -- maybe he'll admit that perhaps it's an issue?

Investigative reporting is investigative reporting, whether it happens online or in a newspaper. Journalists (and investigation subjects) who ignore that do so at their own peril.

No, The Death Of Newspapers Does Not Mean An Age Of Corruption

A few folks have sent in Paul Starr's long but thoughtful article in The New Republic, which worries that, thanks to newspapers dying, we'll be entering a new age of corruption, since no one will be watching government officials like investigative reporters have in the past. The article is well worth reading, and brings up a number of interesting points -- but, in the end, fails to make a compelling case for a number of reasons -- most specifically that it relies on both a faulty model of news production and a faulty understanding of economics. This isn't to knock Starr or the article, because the mistakes are subtle, but important.

The first mistake is in looking at news production itself -- and specifically investigative reporting. Starr seems to significantly overestimate how much investigative reporting newspapers do. In fact, investigative reporting is a fairly new phenomenon and has never been a major focus of newspapers. Those bemoaning the supposed "loss" of this function don't seem to recognize how little money has been put towards such investigative reporting in the past. As that second link suggests, most newspapers spend more on their comics pages than on investigations.

Furthermore, the article brushes off the fact that the increase in information out there, and the ability for almost anyone to consume different media, means that a lot more people can participate in the process itself. Starr does mention some of this, but seems to brush it off without a deeper investigation. And that leads to quotes like the following:

Altogether, according to the governor's office, the number of full-time statehouse reporters in New Jersey has fallen from more than fifty to fifteen in the past decade. That is a lot fewer pairs of eyes to keep watch over state agencies.
Which of course assumes that the only people who can monitor government agencies are reporters. That's simply not true. There are many more "eyes" watching over state agencies -- it's just that they don't do it as a full-time job. That doesn't mean that as a group they're somehow less effective. If well organized, they can be much, much, much more effective -- enabling multiple people to assemble different pieces of the puzzle and work together as a team to unearth problems. This is often brushed off as useless because some of those people might be "biased" or have an "agenda," but, in practice, that issue is often negated. Those with obvious biases or agendas are usually pretty quickly outed.

So, while the nature of the beast may change, there's little evidence that corruption will suddenly be free to roam. Especially in the political realm, where there's so much interest in digging up "dirt" on opponents, it's increasingly hard to keep corruption secret.

The second mistake is much more subtle and quite easy to understand. It's in focusing on the idea that "news" is somehow a public good. Much of the discussion, then, about public goods is based on an older understanding of public goods and what that implies from an economic standpoint. But, that thinking on public goods has gone through something of an economics revolution in the last decade or so, with much of the research being so recent that plenty of well-known economists are still digesting it. The claims that public goods are necessarily "under-produced," because there isn't enough incentive for private providers to supply them, knowing that there will be free riders, is looking less and less true -- especially when it comes to information.

That mistake is based on a simple misconception (which many still hold), that the business model needs to be about the public good itself. When the product is information, that's not true. You can use the information itself to create different business models, by effectively bundling the information (or infinite) good with a corresponding scarcity. In fact, that's exactly what newspapers have done for years, in reality. They've used the information to attract a community -- and then sold that community to advertisers. The problem newspapers face isn't that they're producing a public good -- it's that they never fully realized that they were selling their community's attention, and were unprepared when that community found other places to go.

Starr, unfortunately, only focuses on "non-market" production of public goods, using Yochai Benkler's excellent discussion on "The Wealth of Networks." That's a useful starting point, but it's hardly the end of the discussion. Through bundling and creative business models, you can very much create very strong market production of such infinite goods (which are misnamed "public goods"). The issue is just setting up those proper business models, and we're starting to see more and more examples of those pop up every day.

When you correct for both of these mistakes, you realize that the widespread participation of the community, combined with newer business models for the production of such infinite goods, allows such "investigative reporting" to be done more cheaply -- while actually providing an even larger revenue stream. I recognize that last statement seems like a bit of a leap of faith (especially to those who are worrying about dying newspapers), but as you look through the economic evidence, it's difficult to find a market that wasn't greatly enlarged by the injection of more "infinite goods," combined with a more efficient system for participation.

Don't fear the changes that are coming. They may take a little while to sort out, but the opportunities are huge, and they will be too tempting for some to pass up.

Getting People To Pay For Investigative Reporting Directly

When old school journalists complain about the supposed "threats" from companies like Craigslist and Google or things like blogging, one of the common refrains is: "but who will pay for investigative reporting." The idea is that these other services can replace the basic news facts, but it's tough to see how true investigative reporting will get funded. Yet, as with all markets in a state of flux, we've seen that if there's a real demand, new business models will come along to handle it -- and that seems to be exactly what is happening in the investigative reporting realm. The NY Times points out a few different experiments in other forms of funding investigative reporting, with the bulk of the story talking about getting interested parties to pay up front for an investigation. In other words, if there is a concerned group of folks worried about, say, dangerous chemicals leaking into the drinking water, it could put that story up, and if enough people contribute to the investigation, a reporter can get paid and do the investigation.

While there are some concerns that this would lead to biased journalism, there's nothing saying that the journalist's results have to support the initial worry. In fact, I would imagine that in cases where folks are worried about things like chemicals in the drinking water, they'd be much more relieved to find out that it's really nothing. Either way, this model fits exactly with the business models we've discussed in the past: getting people to pay for the creation of content. The creation of new content is a scarce good, and there may be some group of people for whom its worth paying for. In this case, the example fits the business model we describe for content after it's created as well, since the organization doing these investigative reports will then offer them to newspapers for free (so long as they don't want an exclusive right -- which would not be free). That's exactly how it should be: it costs money for the initial creation, but then the content is freed, where it adds much more value (and attracts more people to fund later stories). Who knows if this particular effort will work (execution is everything, after all), but the model is sound, and shows that despite gloomy whining from old school reporters, the new business models will show up.
